Terms & Conditions
The Terms and Conditions shall form part of the contract between Mountain Bike Scotland and the participant. By booking the trip and paying the deposit you are deemed to have accepted the following terms and conditions.
Deposit and Final Payment
Your payment is not deemed made until it is received.
All payments are in British Pounds (GBP).
A deposit of the trip price is required to confirm the booking. It is due when booking. The deposit forms part of your final payment.
The deposit amount is:
£100 (GBP) when trip is booked during an 'offer period'
£250 (GBP) if trip is booked during a normal booking period.
The balance of the trip cost is due 21 days prior to the trip start date. Mountain Bike Scotland reserves the right to cancel the reservation should the final payment not be paid by the due date. No refund will be made in these circumstances.
Young Tour Participants / child policy:
Tour participants who are less than 18 years old on the tour departure date must be accompanied by an adult.
Cancellation by you
All cancellations must be received in writing via letter to our office or email to contactus@scotlandmountainbiking.com and will be effective from the date of receipt.
When cancellation the following amounts will be retained per person:
cancellation more than 42 days (6 weeks) prior to trip start date: full deposit amount
cancellation 21 - 41 days prior to trip start date: 50% of the total trip cost (GBP)
When cancellation is received within 20 days of departure, 100% of total trip price will be charged.
Exceptions to this policy cannot be made for any reason, including weather or personal emergencies, also we suggest you to take out an appropriate travel insurance policy.
Cancellation by us:
Scheduled group trips are subject to a minimum of 3 people. On the rare occasion when less than the minimum numbers of people have booked we reserve the right to cancel the trip and will advise you of such cancellations not later than 4 weeks before the trip start date. We will offer you alternative arrangements; if you do not accept these we will refund all payments you have made to us but we will not be liable for any claims for any additional costs incurred by you.
Changes
Changes made by you to your booking may incur a fee up to 50 GB Pounds per amendment. In addition, a cancellation fee may be due.
Changes to the Itinerary
Our trips are organized long in advance and it may become necessary to make alterations to your holiday. We may also require to adapt the tour to the lodgings availability. Where the change is of a significant nature we will, where practical, advise you of such changes before you depart.
Sometimes, because of circumstances beyond our control, the sequence of your itinerary may also be adjusted slightly. Occasionally we may be forced to make changes en route due to forestry works, river flooding, poor trail conditions, weather, hunting season or other circumstance. This list is not intended to be exhaustive..
No responsibility is accepted for delays experienced as a result of changes, poor road conditions, weather, vehicle breakdown or any other reason. Group sizes may also vary slightly due to booking patterns or late cancellations by other clients. No refunds will be made in any of these situations.
It is a condition of joining the trip that adequately insure has been procured. Insurance must cover medical and appropriate personal risks for the activities engaged in. Insurance must also cover trip cancellation, ambulance, air rescue and repatriation.
Mountain Bike Scotland cannot be held responsible for any unforeseen delays in your ferry crossings, border crossings, and changes to accommodation regardless of cause. Participants are advised to ensure that all onward travel plans have sufficient contingency for these unforeseen circumstance.
Miscellaneous:
There is no refund for arriving late or leaving a trip early
Mountain Bike Scotland reserves the right to make route and accommodation modifications as needed.
On the rare occasions when Mountain Bike Scotland must cancel a trip, all payments received to date will be refunded, which constitutes full settlement.
Mountain Bike Scotland is not responsible for expenses incurred in preparation for any canceled trips.
Bike Rental (when applicable):
The equipment, including all accessories supplied, is let out on hire. The equipment remains the property of Mountain Bike Scotland or Mountain Bike Scotland's partners and subcontractors.
You undertake not to misuse the equipment and to return it with all accessories in the same condition as when received, ordinary wear excepted. Mountain Bike Scotland shall be entitled to charge you for any damage caused to the equipment during the period of hire. In the event of a breakdown Mountain Bike Scotland will do their best to repair or procure the repair of the equipment.
Mountain Bike Scotland shall not be liable for any damage or loss whatsoever, through breakdown or other defects in the equipment or other circumstances beyond Mountain Bike Scotland's control. You shall be liable to Mountain Bike Scotland in respect of all costs, claims, expenses and demands which he may suffer or incur and which arise directly or indirectly out of use of the equipment during the period of hire. Mountain Bike Scotland reserves the right to charge you for partial or full settlement of any such claim.
In the event of the equipment being stolen or lost, Mountain Bike Scotland reserves the right to call upon you to be liable to Mountain Bike Scotland for the replacement value of the equipment. However, should the equipment subsequently be returned in a satisfactory condition, Mountain Bike Scotland hereby undertakes to refund you any sums taken in respect of lost or stolen bikes.
You will ensure that the equipment is adequately secured when not in use, will not use the equipment whilst under the influence of drink or drugs.
Release and Indemnity
Your booking is accepted on the understanding that you realize the hazards involved in this kind of tour, including injury, disease, loss or damage to property, inconvenience and discomfort. You understand and accept that your proposed tour may expose you to inherent dangers. Activities such as cycling, walking and mountain biking are physically taxing and a suitable level of fitness is recommended. You accept that you may be traveling through areas which can be subject to, among other things, unfavourable climatic, physical, or health conditions. You accept these dangers and unfavourable conditions.
Activities such as cycling, hiking and mountain biking are physically testing and a suitable level of fitness is needed. We strongly recommend a visit to your doctor and dentist before your holiday. You must ask your doctor about your aptitude to do the tour.
During guided or full support tours, you are under the control of your tour guide for the whole holiday. He or she has the authority to determine your suitability to continue with your tour
By booking, you also agree to the following:
I am aware that any form of travel, including mountain biking, cycling and walking tours, trip planning and accommodation rentals, contains some inherent risks of illness, injury or death, which may be caused by negligence of others, the characteristics of the lodgings and its surroundings, physical exertion for which I am not prepared, consumption of alcoholic beverages, forces of nature, or other agents known or unknown. I acknowledge that the enjoyment and excitement of adventure travel is a reason for my participation, and is derived in part from the inherent risk of such travel. I am also aware that medical facilities may not be readily available or accessible during some of the time in which I am participating in the trip. I also acknowledge that I have received no information from Mountain Bike Scotland, its managers, employees, agents or representatives (hereafter collectively referred to as "Mountain Bike Scotland") that in any way minimizes the risks of such travel.
Therefore in consideration of arrangements made by Mountain Bike Scotland for travel by me and its providing tour services itself or as agent, I agree to:
1. ASSUME AND ACCEPT ALL RISKS, DANGER AND HAZARDS, including without limitation, illness, injury, death, loss or damage to my person or property, in any way connected with travel arranged by Mountain Bike Scotland for me.
2. WAIVE ANY AND ALL CLAIMS that I may have against Mountain Bike Scotland in respect of such travel.
3. RELEASE AND DISCHARGE Mountain Bike Scotland from any and all liabilities for any loss, damage, injury or expense that I, or my next of kin or personal representatives, may suffer or incur as a result of my participation in travel arranged by Mountain Bike Scotland INCLUDING NEGLIGENCE ON THE PART OF Mountain Bike Scotland.
4. INDEMNIFY AND SAVE HARMLESS Mountain Bike Scotland from any and all liabilities for property damage, personal injury or death suffered by me or by a third party as a result of my participation in travel arranged by Mountain Bike Scotland
I further agree that this release and indemnity shall be binding upon me, my heirs, next of kin, personal representatives and any minor accompanying me. I agree that this release and indemnity, and all rights and liabilities referred to herein, shall be interpreted in accordance with and governed by the laws of the United Kingdom and any action arising there from shall be within the exclusive jurisdiction of Scottish courts.
I have carefully read this release and indemnity and fully understand its contents. I am aware that this document affects my legal rights and liabilities and those of my heirs, next of kin and personal representatives.
